This Privacy Policy is maintained by HOWDY GLOBAL PTY LTD ACN 672 900 408 (“we”, “us”

and “our”) and relates to the collection and use of personal information you may supply to us or we

may collect from you through your dealings with us, such as basic profile details and the types of

people you would like to meet. We also collect information about your use of our services such as

access logs, as well as information from third parties, like when you access our services through

your social media account or when you upload information from your social media account to

complete your profile on the Howdy mobile application (“App”).

We recognise the importance of protecting the privacy of your information, in particular information

that is capable of identifying an individual ("personal information"). This Privacy Policy governs the

manner in which your personal information will be dealt with including but not limited to collection,

access, storage and use of personal information which we obtain as part of our business operation.

By accessing the App, our website, systems or databases maintained by us or otherwise

transacting with us, you agree to and acknowledge the content of this Privacy Policy. This Privacy

Policy is in addition to any other agreement or terms and conditions applicable to our dealings with

you.

Personal Information

1. Personal information about you is collected only when knowingly and voluntarily submitted

and when reasonably required by us to perform one or more of our functions or activities.

2. It is our intention that this Privacy Policy will protect your personal information from being

dealt with in any way that is inconsistent with applicable privacy laws in Australia and New

Zealand including the Australian Privacy Principles under the Privacy Act 1988 (Cth)

(“APPs”) and the New Zealand Privacy Principles under the Privacy Act 2020 (“NZPPs”). The

type of personal information that we may collect and hold includes:

 When you create an account, you provide us with at least your phone number and

email address, as well as some basic details necessary for the service to work, such

as your name, gender, date of birth, location, who you would like to connect with

(including sexual preference), whether you are a farmer (and the type of farmer), or if

you are actively seeking to connect with a farmer

 When you complete your profile, you have the option to share your sexual orientation,

ethnicity, religious beliefs, and political opinions with us. Where you provide such

information to us, you consent to us using it for the purposes identified and as laid out

in this Privacy Policy. You can also share additional information with us, such as

details on your bio and your interests, as well as content such as photos, videos, and

audio clips. To add certain content, like pictures or videos, you may allow us to

access your device’s camera, photo album, or microphone.

 When you participate in surveys, focus groups or market studies, you give us your

insights into our products and services, responses to our questions and testimonials.

 When you choose to participate in our promotions, events or contests, we collect the

information that you use to register or enter.

 if you contact us (e.g., through our customer care team or on social media), we collect

the information you give us during the interaction.

 if you share with us information about other people (e.g., if you use contact details of

a friend for a given feature), we process this information on your behalf in order to

complete your request. You must only share information with us about other people

with their prior consent. If other people share your information with us (e.g., if they

use your contact details for a given feature), we process this information on their

behalf in order to complete their request but we will take reasonable steps to let you

know.

 we also process your chats with other users as well as the content you publish to


operate and secure the services, and to keep our community safe.


3. Where it is reasonable and practical to do so we will only collect personal information about

you from you. You have no obligation to provide any information requested by us however if

you choose to withhold personal information from us it may prevent us from being able to

provide you with the services that you have requested.

4. We will take reasonable steps to ensure that your personal information is accurate, complete

and up-to-date as soon as practicable after receiving your notification of any error or

inaccuracy.

5. If you provide us with someone else’s personal information, you should only do so if you

have that person’s authority or consent to provide us with their personal information. You

should also take reasonable steps to inform them of the existence of and the matters set out

in this Privacy Policy.

6. If we receive personal information about you from a third party, we will take reasonable steps

to let you know that we have received this information and about the existence of and the

matters set out in this Privacy Policy.

Use of Information

7. Personal information collected from you is used for the following purposes:

 to offer you our services and features;

 to help you connect with other users;

 contact you with information about the App (e.g., updates and new features);

 personalise the App and the content we deliver to you;

 to manage your account with us;

 to liaise with others in our organisation to manage or administer aspects of the services

that we provide to you;

 to communicate with you regarding other relevant services we provide;

 to prevent, detect and fight fraud and other illegal and unauthorised activities;

 to ensure legal compliance;

 to provide offers and operate advertising any marketing campaigns;

 to conduct surveys;

 for seeking your feedback; and

 for any other business related purposes.

8. Personal information is held in paper archives, by electronic or computer data base and

remotely in cloud based storage systems.

Disclosure

9. We will not disclose your personal information, except in the limited circumstances described

here:

 With other users: you share information with other users when you voluntarily

disclose information on the service (including your public profile). Please be careful

with your information and make sure that the content you share is content that you are

comfortable being visible.

If you choose to limit the audience for all or part of your profile or for certain content or

information about you, then it will be visible according to your settings.

If someone submits a report involving you (such as a claim that you violated our Terms

and Conditions of Use), we may communicate to the reporter actions, if any, we took


as a result of their report.

 With our service providers and partners: we may engage third parties to provide

you with services on our behalf. In those circumstances, we may disclose your

personal information to those third parties in order to meet your request for services.

 For corporate transactions: we may transfer your information if we are involved,

whether in whole or in part, in a merger, sale, acquisition, divestiture, restructuring,

reorganization, dissolution, bankruptcy or other change of ownership or control of our

business.

 With law enforcement / when required by law: we may also disclose your personal

information where it is required or authorised by or under an Australian or New Zealand

law or a court/tribunal order or where a permitted general situation exists under the

APPs or NZPPs (as the case may be). Where disclosure is necessary for an

enforcement related activity of an enforcement agency, we will provide written

notification of that disclosure as is required by the APPs or NZPPs (as the case may

be).

 To enforce legal rights: we may also share information: (i) if disclosure would mitigate

our liability in an actual or threatened lawsuit; (ii) as necessary to protect our legal

rights and legal rights of our members, business partners or other interested parties;

(iii) to enforce our agreements with you; and (iv) to investigate, prevent, or take other

action regarding illegal activity, suspected fraud or other wrongdoing.

 With consent at your request: we may ask for your consent to share your information

with third parties. In any such case, we will make it clear why we want to share the

information.


10. As part of provision of the services to you we may store your personal information using

online software. The personal information that you provide to us may be transferred to the

servers of our software providers as a function of transmission across the internet. By

providing your personal information you are consenting to that personal information being

transferred to and stored on the servers as set out in this Policy. However, as the third

parties who host our servers do not control, and are not permitted to access or use your

personal information (except for the limited purpose of storing the information), we do not

“disclose” personal information to those server hosts, whether or not they are located

overseas.

11. We are an Australian registered company carrying on business in both Australia and New

Zealand therefore some of the above disclosures (such as to our service providers) may be

made to Australian companies as such those companies may not be required to protect your

information strictly in accordance with New Zealand’s privacy laws however we will take

reasonable steps to ensure that they will protect your information in accordance with the

Australian equivalent privacy laws.

Security

12. We strive to ensure the security, integrity and privacy of personal information collected and

held by us, and we review and update our security measures in light of current technologies.

Unfortunately, we cannot guarantee that our data storage measures are totally secure.

13. However, we will endeavour to take all reasonable steps to protect the personal information

we collect from you from misuse, interference, loss and unauthorised access, modification or

disclosure.

14. Where the personal information is no longer required for the purpose for which it was

collected (or a permitted secondary purpose) we will take reasonable steps to destroy or de-

identify the information.

IP Addresses

15. If information is gathered by the App, our website/portal or online database, our web servers

may gather your IP address to assist with the diagnosis of problems or support issues with


our services. This information is gathered in aggregate only and cannot be traced to an

individual user.

16. Our App and website may contain links to third parties’ websites, including sites maintained

by related entities. Those other websites are not subject to this Privacy Policy. You should

familiarise yourself and ensure you are comfortable with any particular privacy policies

governing the use of those websites prior to such use.

Cookies and Applets

17. We may use cookies to provide you with a better experience when using the App and our

website/portal. These cookies allow us to increase your security by storing your session ID

and are a way of monitoring single user access. This aggregate, non-personal information is

collated and provided to us to assist in analysing the usage of the site.

No Children Allowed

18. Our services are restricted to individuals who are 18 years of age or older. We do not permit

individuals under the age of 18 on our platform. If you suspect that a user is under the age of

18, please use the reporting mechanism available on the service.

Access to Information

19. Depending on which services you are attempting to access, you may be able interact with us

anonymously or using a pseudonym. However, this will mean that there are some products

and services that you will not be able to enjoy. These include online orders/purchases.

20. We will endeavour to take all reasonable steps to keep information about you accurate and

up to date. If, at any time, you discover that information held about you is incorrect, you may

contact us to have the information corrected. Further you may request access to any of your

personal information we hold except if the provision of the information is contrary to any

applicable privacy law.

21. In addition, our employees and the contractors who provide services related to our

information systems are obliged to respect the confidentiality of any personal information

held by us.

22. If you wish to make a complaint regarding any aspect of the collection, access to, use or

storage of personal information by us, please make your complaint in writing to the address

below. We will consider your complaint promptly and contact you to seek to resolve the

matter. If we have not responded to you within a reasonable time, you are entitled under

privacy legislation to make a complaint to:

 the Office of the Australian Information Commissioner if you are based in Australia; or

 the Office of the Privacy Commissioner if you are based in New Zealand.

How long is it held for?

24. We retain personal information for as long as necessary to fulfill the purposes for which it

was collected. This retention period is determined at our discretion, taking into account the

nature of the information and our operational needs.

25. We will take all reasonable steps to securely destroy or de-identify personal information once

it is no longer required for its original purpose or as mandated by law.

26. To request the deletion of your personal information from our systems, please send your

Changes to Privacy Policy

27. We reserve the right, at our discretion, to modify, add to or remove portions of this Privacy

Policy at any time. You should review this Privacy Policy periodically so that you are updated
